1. About MyMemoryDrop

These Terms & Conditions govern your use of the MyMemoryDrop website and any services offered through it. MyMemoryDrop is operated by JDMWEBS, based in Belgium.

By accessing or using this website, requesting a demo, creating an account or purchasing or using our services, you agree to these Terms & Conditions. If you do not agree with them, you should not use our services.

2. Our Services

MyMemoryDrop provides digital tools and services designed to help users create, collect, manage and share memories, messages, photographs, videos and other content in connection with events, celebrations and other experiences.

The exact features, functionality, availability and pricing of our services may vary depending on the product, subscription or package selected.

We may improve, update or modify features of the service over time. Where a change materially affects a paid service, we will take reasonable steps to inform affected customers where appropriate.

3. Eligibility and Account Responsibility

You must have the legal capacity to enter into an agreement to purchase or use paid MyMemoryDrop services.

If an account is required for a particular service, you are responsible for providing accurate information, keeping your login credentials confidential and for activities carried out through your account.

You must notify us promptly if you become aware of any unauthorised access to or use of your account.

4. Orders, Pricing and Payment

Prices for MyMemoryDrop products and services are displayed on the website or communicated to you before an order is confirmed. Unless stated otherwise, applicable taxes will be added or included as indicated during the ordering process.

Payment must be made using one of the payment methods offered at the time of purchase. An order is considered accepted when we confirm it or make the purchased service available to you.

We reserve the right to correct obvious pricing or description errors. If such an error affects an order you have already placed, we will contact you and, where applicable, offer you the choice to proceed on the corrected terms or cancel the affected order.

5. Right of Withdrawal and Cancellations

If you are a consumer in the European Economic Area, you may have a statutory right to withdraw from a distance contract within 14 days, subject to the conditions and exceptions provided by applicable consumer law.

For digital content or digital services that are supplied before the end of the withdrawal period, we may ask for your express consent to begin performance immediately and, where legally applicable, your acknowledgement that you will lose your right of withdrawal once performance has begun or the digital content has been supplied.

Any cancellation or refund rights that apply to a particular product or service will be communicated during the ordering process or in the applicable offer. Nothing in these Terms limits any mandatory consumer rights available to you under applicable law.

6. User Content

MyMemoryDrop may allow you or people you invite to upload, submit, store or share photographs, videos, messages and other content (“User Content”).

You retain ownership of your User Content. By providing User Content through MyMemoryDrop, you grant us the limited rights necessary to host, store, process, display and otherwise handle that content solely for the purpose of providing and operating the service.

You are responsible for ensuring that you have the necessary rights and permissions to provide User Content and that its use through MyMemoryDrop does not infringe the rights of others or violate applicable law.

7. Acceptable Use

You may only use MyMemoryDrop for lawful purposes and in accordance with these Terms.

You must not use the service to upload, distribute or otherwise make available content that is unlawful, fraudulent, defamatory, threatening, abusive, discriminatory, obscene, infringes intellectual property or privacy rights, contains malicious software, or otherwise violates the rights of another person.

You must not attempt to gain unauthorised access to MyMemoryDrop, interfere with the proper operation or security of the service, circumvent technical restrictions, or use the service in a manner that could damage, disable or overload our systems.

We may remove or restrict access to content, or suspend access to the service, where reasonably necessary to address unlawful use, security risks, violations of these Terms or legal obligations.

8. Intellectual Property

The MyMemoryDrop website, software, design, branding, logos, text, graphics and other materials provided by us are owned by or licensed to JDMWEBS and are protected by applicable intellectual property laws.

Your use of MyMemoryDrop does not transfer any ownership rights in our intellectual property to you. You may use the service and its materials only for their intended purpose and in accordance with these Terms.

You may not copy, reproduce, modify, distribute, sell, license, reverse engineer or commercially exploit our software, website or proprietary materials except where we have expressly authorised you to do so or where such restriction is prohibited by applicable law.

9. Availability and Changes to the Service

We aim to keep MyMemoryDrop available and functioning reliably, but we do not guarantee that the website or services will always be available without interruption, delay or error.

Access may occasionally be restricted or unavailable due to maintenance, updates, technical problems, security measures or circumstances beyond our reasonable control.

We may update, improve or modify MyMemoryDrop over time. We will not intentionally remove essential functionality from a paid service without reasonable justification and, where required by applicable law, appropriate notice or remedies will be provided.

10. Third-Party Services

MyMemoryDrop may rely on or integrate with third-party services, such as hosting providers, payment processors, email services or other technology providers.

We are not responsible for the availability, content or independent actions of third-party services that are outside our reasonable control. Your use of certain third-party services may also be subject to their own terms and policies.

Where we engage third-party providers to process personal data on our behalf, the handling of that personal data is addressed in our Privacy Policy.

11. Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

To the extent permitted by law, JDMWEBS will not be liable for indirect or consequential losses arising from the use of, or inability to use, MyMemoryDrop where such losses were not reasonably foreseeable.

You are responsible for maintaining appropriate copies or backups of User Content that is important to you. Although we take reasonable measures to provide a reliable service, MyMemoryDrop should not be used as the sole permanent storage location for irreplaceable photographs, videos or other content.

Any limitations of liability in these Terms apply subject to mandatory consumer protection rights and other rights that cannot legally be excluded or restricted.

12. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to MyMemoryDrop, our business practices or applicable legal requirements.

The updated Terms will be published on this page with a revised “Last updated” date. Where changes materially affect an existing paid service or your rights, we will provide additional notice where required by applicable law.

Your continued use of MyMemoryDrop after updated Terms become applicable constitutes acceptance of those Terms, except where applicable law requires another form of consent.

13. Governing Law and Contact

These Terms & Conditions are governed by Belgian law, without prejudice to any mandatory consumer protection rules that may apply in your country of residence.

Any dispute relating to these Terms or the use of MyMemoryDrop will be submitted to the competent courts in accordance with applicable law. If you are a consumer, this does not deprive you of any mandatory rights regarding jurisdiction or dispute resolution available under applicable consumer law.
